2. These terms
These terms cover use of our website and consumer purchases of goods through our online store.
Please read them alongside our Shipping Policy and Returns and Refunds Policy, which provide further details about your purchase.
Our Privacy Policy explains how personal information is used. Using this website does not itself give consent to optional marketing or tracking.
Nothing in these terms limits your statutory consumer rights.
Workshop work, fitting services and trade purchases may require separate terms agreed before the relevant contract is made.
3. Placing an order
Please check product details, quantities, delivery information and the total price before submitting your order. You must provide accurate information and be authorised to use your chosen payment method.
Placing an order is an offer to purchase the goods. We will acknowledge receipt electronically. An acknowledgement alone does not mean that we have accepted your order.
A contract is formed when we confirm acceptance of your order. If we have not expressly accepted it earlier, dispatch confirms acceptance of the goods dispatched.
Before acceptance, we may decline an order for a genuine reason, such as unavailable stock, an unresolved pricing error, unsuccessful payment or reasonable concerns about fraud. We will tell you if we cannot accept your order and promptly refund any payment taken for it.
Your statutory cancellation rights apply even after an order has been accepted.
4. Prices and payment
Prices are shown in pounds sterling (GBP). Consumer prices include applicable taxes. Delivery charges and any other compulsory charges will be shown before you place your order.
Available payment methods are displayed at checkout.
We may change prices for future purchases, but we will not increase the agreed price of an accepted order without your agreement.
If we discover a pricing or product-information error before accepting your order, we will explain the correction and give you the choice of proceeding on the corrected basis or cancelling for a refund.
Once a contract has been formed, an error does not give us an unrestricted right to change or cancel it.
Any promotion-specific conditions will be made available before purchase and will not override your statutory rights.
5. Products and compatibility
Products must be as described, of satisfactory quality and fit for any purpose made known to us where the law requires.
Please check product descriptions, part numbers, dimensions and fitment information before ordering. Compatibility may depend on your motorcycle’s model, year, specification and existing modifications.
If you are unsure, contact us before purchase or installation. Please give us accurate information about your motorcycle and any relevant modifications.
Checking compatibility does not remove our responsibility for inaccurate product descriptions or advice on which you are legally entitled to rely.
Product photographs may show an item fitted to a motorcycle or alongside accessories. The product description identifies what is included. If this is unclear, please ask before ordering.
We will not substitute a materially different product without your agreement.
6. Installation and use
Inspect parts before fitting and follow the manufacturer’s instructions. Safety-critical parts should be installed by a suitably competent person.
If a part appears damaged, incorrect or unsuitable, stop and contact us before fitting or using it.
Some products may be intended only for competition, off-road or other restricted use, as stated in their descriptions. Follow the stated restrictions and applicable requirements concerning road use, insurance and vehicle modifications.
Damage caused by incorrect installation, misuse or an unrelated modification is not automatically a product defect. This does not remove your rights where goods are faulty, misdescribed or otherwise fail to meet legal requirements.
7. Stock and supplier lead times
Some items are physically held at Deathproof. Others must first be obtained from an external supplier.
Items physically in stock at Deathproof are normally dispatched within 24 hours. Courier delivery time is additional.
Supplier items can take up to 7 working days to reach Deathproof, after which we normally dispatch them the following day. Products displaying a 7–10 working day estimate generally include the supplier lead time and onward delivery.
Supplier estimates depend on stock being available at the supplier. Items awaiting supplier restock may take longer.
An Estimated supplier restock date is an estimate of when stock will become available at the supplier. It is not a confirmed dispatch or customer delivery date.
If an order contains several items, we normally wait until all items have arrived at Deathproof before sending the order together.
Working days are Monday to Friday, excluding bank holidays.
8. Shipping and delivery
We currently deliver within the United Kingdom using Royal Mail, UPS and DPD.
Our delivery options are:
-
Standard delivery — £6.95: estimated courier transit time of 24–48 hours after dispatch.
-
Next-day delivery — £8.95: next-day courier service after dispatch, subject to availability for your address and the courier’s delivery schedule.
-
Free 48-hour delivery on orders over £100: estimated courier transit time of 48 hours after dispatch.
Available services and the total delivery charge are shown at checkout.
Next-day delivery does not shorten supplier lead times. It begins only once your order is ready and has been dispatched.
Weekends, bank holidays and delivery location can affect courier arrival times. Please see our Shipping Policy for full details.
Unless a different delivery period has been agreed, we must deliver without undue delay and within 30 days of the order.
If we become aware of a delay, we will contact you and discuss the available options. A delay does not remove your statutory cancellation or refund rights.
Where the law allows, you may cancel immediately if we refuse to deliver or miss a delivery deadline that was essential and made known to us before the contract. In other cases, you may give us a reasonable additional delivery period and cancel if we fail to meet it.
Goods sent through our delivery services remain our responsibility until they come into your possession or that of a person you have nominated to receive them.
Please contact us if a parcel is missing, damaged or incorrect so we can investigate and arrange an appropriate resolution.
9. Changing your mind
For eligible online purchases, you may cancel without giving a reason from the time you place your order until 14 calendar days after the day you receive the goods.
Where goods from one order arrive separately, the cancellation period normally runs from receipt of the last item.
Tell us clearly that you wish to cancel by emailing info@deathproofcycles.com or writing to our correspondence address. Send the goods back no later than 14 calendar days after the day you notify us.
Cancellation does not depend on us approving it first.
You are responsible for direct return postage for a change-of-mind return where this was properly disclosed before purchase.
For a valid cancellation, we refund without undue delay and within 14 calendar days after receiving the goods back or receiving evidence that you have sent them back, whichever is earlier. Where there are no goods to return, we refund within 14 calendar days of cancellation.
When you cancel the whole order, we also refund the original standard delivery charge. The additional cost of a premium delivery option is not refundable for a change-of-mind cancellation.
See our Returns and Refunds Policy for the return address, cancellation form and full details.
10. Fitted, used and custom parts
You may inspect goods as you would in a shop.
Installation, use or modification beyond what is necessary to establish a part’s nature, characteristics and functioning may reduce its value.
Where legally permitted, we may deduct the actual resulting loss in value from a change-of-mind refund. A deduction may reach the full item price if the item has lost all its value, but this is not automatic merely because a part has been fitted.
We assess each return individually and explain any deduction. We do not charge a standard restocking fee. We will not deduct for diminished value where we failed to provide the cancellation information required by law.
Outside statutory cancellation rights, we do not accept fitted or used parts for change-of-mind returns.
The statutory change-of-mind right generally does not apply to goods made to your specifications or clearly personalised. A standard catalogue part obtained from a supplier specifically for your order is not automatically a custom-made product.
Sale items have the same statutory rights as full-price items.
These provisions do not restrict rights concerning faulty or misdescribed goods.
11. Faulty or incorrect goods
Contact us if goods are faulty, damaged, incorrect or not as described.
Under UK consumer law, you normally have a short-term right to reject faulty or misdescribed goods within 30 days of delivery for a refund. After that, repair, replacement, price reduction or refund rights may apply depending on the circumstances.
We will arrange a suitable return or cover reasonable return costs where goods fail to meet legal requirements.
A manufacturer’s warranty is additional to your statutory rights. You may raise a problem with us as the seller rather than being required to deal exclusively with the manufacturer.
12. Our responsibility
We are responsible for foreseeable loss or damage caused by our breach of contract or failure to use reasonable care and skill. Loss is foreseeable if it is an obvious consequence or was contemplated by both parties when the contract was made.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot lawfully be excluded.
We do not exclude your rights concerning ownership, satisfactory quality, fitness for purpose or goods matching their description.
We are not responsible for damage to the extent that it is caused by misuse, incorrect installation or an unrelated modification rather than a defect in our goods, our advice or our work.
Supplier or courier problems do not automatically remove our obligations to you.
13. Website use and accounts
Use the website lawfully. Do not introduce malicious software, attempt unauthorised access, misuse another person’s details or interfere with the website’s operation.
Keep any account login details secure and tell us promptly if you suspect unauthorised access.
We may reasonably restrict access to address fraud, security threats or unlawful use. This does not remove rights relating to an existing order.
14. Website content and external links
Website text, photographs, graphics and branding belong to us or their respective owners.
You may view, save and print information for personal use, including keeping copies of these terms and your order information. Other uses require permission unless permitted by law.
Links to external websites are provided for convenience. Their operators are responsible for their own content and services. This does not exclude any responsibility we have for statements or commitments we make ourselves.
15. Shopify and personal information
Shopify provides the platform for our online store. Your contract to purchase goods from this store is with Deathproof Cycles Limited.
Shopify processes information about visits, purchases and other interactions to provide its services. We use Shopify Network Intelligence, through which Shopify also uses information from interactions with our store, other merchants and Shopify to provide enhanced services, including personalisation and advertising.
Information may be shared with Shopify and relevant providers in other countries.
Our Privacy Policy, the Shopify Consumer Privacy Policy and the Shopify Privacy Portal explain the relevant processing and available choices.
Nothing in these terms removes legal rights you may have against Shopify or another provider.
16. Complaints
Please email info@deathproofcycles.com with your order number, details of the problem and the outcome you are seeking. You can also write to our correspondence address.
We will investigate and work with you to resolve the complaint.
If we cannot resolve a consumer complaint directly, we will provide information about an appropriate alternative dispute resolution provider and explain whether we are willing or obliged to use that service, as required by law.
Your right to seek advice or bring a court claim is unaffected.
17. Changes to these terms
We may update these terms for future orders. The terms in force when your contract was made will continue to apply to that order unless a change is required by law or expressly agreed with you.
We will not retrospectively remove rights or more generous terms that applied to an existing purchase.
If a provision is found to be unenforceable, the remaining provisions continue to apply where they can operate fairly and lawfully.
18. Governing law
These terms are governed by the law of England and Wales.
If you live in Scotland or Northern Ireland, you retain the protection of any mandatory consumer laws that apply where you live. You may bring proceedings in the courts available to you under applicable consumer jurisdiction rules, including the courts of your home part of the United Kingdom where permitted.
